NY23 not over yet? Apparently in the rus…

NY23 not over yet? Apparently in the rush to get Bill Owens into the congressional seat, they never bothered to check the vote tallies… which were apparently off– way off. Syracuse Post-Standard reports that in recounting the ballots, several precincts mistakenly phoned in 0 votes for Doug Hoffman on election night… Owens’s election night lead is now cut roughly in half, and there’s still the absentee and military ballots left to count (roughly 10,000)… it’s a really long shot, but Doug Hoffman appears to still have a mathematical shot of winning.

    Should Hoffman actually win the vote count, I wonder if the fact that he already conceded will bar him from accepting the position.

      I believe that the law says if Hoffman indeed won the seat, it’s his, and they must throw Owens out, regardless of whether or not there’s a concession. As for what he’s allowed to do as far as challenging the vote at this point, that’s a lot more limited. Basically, it’s Owens’s seat until/unless Hoffman wins the final tally. I know the Hoffman campaign is exploring its legal options, and considering the fact that his concession was based on erroneous information, he may have a case in court to be able to do some more things.
