Which Republican will cave first on the Supreme Court nominee? My guess is John McCain

Just a few short years ago, the Republicans had a majority in the U.S. Senate, but not 60. Traditionally, the Senate filibuster applies to legislation, not budget bills (see: reconciliation) or judicial appointments. When the Dems threatened to try to use the filibuster to block Bush’s Supreme Court nominations, it was McCain who jumped in and created the “Gang ‘of 14” – he Usurped the President’s power and put his committee in charge of deciding which of President Bush’s choices would be “acceptable”.

So now McCain’s actions come home to roost. There is no way any Democrat is going to oppose anyone Obama submits. They won’t be undercutting “their” President the way McCain did. Since the Gang of 14 sidestepped the issue of whether or not the Senate can filibuster Judicial appointments, it’s probable the issue WILL be resolved now, and not in the favor of the current Republican minority – especially if McCain votes “Yes” for approval. Remember that McCain was thinking of having Joe Lieberman as his running mate, and that he could see himself as a Democrat in 2001.
