Telling Right from Wrong

The Supreme Court has ruled 8-0 in throwing out the basis of the main conviction of two business leaders convicted of depriving their shareholders of “honest services”.

The basis of the decision is that the 5th amendment requires that in order to have “due process”, the crime of which you are accused must be clearly defined what is and isn’t improper behavior, and the “Honest services” law is way too vague. The Conservatives wanted to do more than reverse the convictions and invalidate the entire law.

As Solicitor General of the United States, it was Supreme Court nominee Kagan who had argued that the “honest services” law was just and needed to be upheld.

    I have had a consistently strong negative viceral reaction to pictures of Kagan. Everything I’ve read about her past history supports that visceral reaction. I hope the Republicans have the gumption to aggressively oppose her nomination.
