The answer is: MSPA

Glenn Beck and Pat put out the throwaway line – “So what law is it that guarantees migrant workers safe housing and transportation?”  Ha ha  *snort* *snort*

The answer is The Migrant and Seasonal Agricultural Worker Protection Act.

It is administered by the Department of Labor’s Wage and Hour division – exactly who the woman they are talking about works for.  She is accurately stating the law (which is different than whether the law is a good law).

The MSPA was passed in 1983 as a replacement for laws originally passed in 1964.   For those keeping score at home, the President of the United States in 1983 was Ronald Reagan.

Facts are such obnoxious things.

You might say…  “but she said the law applies also to undocumented workers!”.    Issuance of  H2A visas for agriculutural workers to legally enter the United States for temporary work is now done by the Department of Homeland Security (which is the umbrella organization over INS).    The Department of Labor has no jurisdiction to deny protection of the law – determining eligibility to work legally is not their department.
