Failed Republican presidential candidate Herman Cain, currently a talk show host on Cumulus media / WSB Atlanta was explaining to a caller this morning why the Republicans are not going to try to impeach President Obama. Unfortunately, he apparently left his Heritage Foundation Pocket Constitution ™ at home.
His explanation why – that should the House vote to bring charges of impeachment, the U.S. Senate would use the filibuster to stall the trial. That could not be more incorrect. The impeachment trial is not “legislation” where the filibuster rule applies. To remove the president from office, the Senate would require a two thirds vote of its members after hearing the evidence. That would require 67 senators. A filibuster, even if it applied, is 60 votes. Republicans currently control 54 Senate seats.
The only reason that Richard Nixon feared removal from office was the Republican leadership (who were in the minority) told Richard Nixon they would not protect him. What are the chances that 13 Democratic Senators would vote to impeach Barack Obama? Well, maybe we should revisit that in a couple days after Benjamin Netanyahu’s speech is over.
A secondary reason is – if by some miracle that happened, Republicans don’t get to choose a new President. President Joe Biden? Even more improbable would be Democratic Senators then voting to impeach President Biden to turn the country over to a Republican president.
Aren’t you glad you didn’t vote for Herman Cain because of white guilt? You really need to let go of that. Dr Ben Carson may love Jesus and have dark skin, but that’s not good enough.

I would trust her further than Cain, but not much. Her actual government experience has been focused on national security and foreign policy. She speaks Russian fluently.
I don’t have much of an impression of what she thinks about domestic policy and out of control spending and regulation. I would listen to her. Cain I wrote off as soon as he was tricked into screwing up the 2012 primary. As I wrote at the time, his “pizza chain CEO” credential was wildly exaggerated. He didn’t build the company – Pillsbury divested the chain and him with it, and he mostly flew it into the ground by forcing franchisees to offer things like fruit pizzas. Most left.
She’s eminently more qualified than the current occupant…
