    The more important lawsuit against the Daily Mail has been moved to New York State and will likely resukt in the same outcome.

  5. USA Today reports that the president has invited four Democrat senators — Heidi Heitkamp of North Dakota, Joe Manchin of West Virginia, Jon Tester of Mointana and Joe Donnelly of Indiana to the White House for lunch on Thursday.

    All four face re-election in two years and all four are from states which Trump won handily.

    Not surprisingly, the separation of powers issue has come to a head in less than a month. The laws giving Donald Trump the absolutete power to exclude people or groups of people from entering the country is a power that Congress clearly gave to the President. It has been used many times by many Presidents. There is no requirement in the law that the President has to justify his actions.

    The Ninth District Court has ruled to overturn Trump’s temporary exclusion of countries which have significant issues with anti American terrorism. Non-citizens do not have 15th amendment rights to equal protection under US Law, nor do they have the right to practice their religion inside the United States.

    One of the enumerated powers in the US Constitution given to Congress is to organize the Federal judicuary and define its organization and limit its jurisdiction. Only the Supreme Court is described in the Constitution, and many of its features are either the result of laws passed by Congress or by tradition. You will not find the number of justices on the Supreme Court or the doctrine of stare decisis anywhere in the Constitution.

  12. Gen. Mike Flynn has resigned as National Security Adviser. It appears that his undoing was to lie to the vice president, who went on national TV saying something which turned out later to be untrue.

  13. The Wall Street Journal is reporting tonight that U.S. intel officials have withheld material from POTUS because they are concerned it could be leaked or compromised.

  14. The office of the Director of National Intelligence has issued a statement denying that the intelligence community is withholding information from the president.

      Just a random thought – maybe the Supreme Court should choose the head of the Department of Justice, subject to Senate approval, not the President – so the DOJ is not obligated to protect the President, but the DOJ is not moved into the Judiciary

        I don’t own any pink t-shirts.

        The leaves on my porch need sweeping, but it is somewhat futile. The lawn care guys (at least the former Mexican ones) thought it was useful to blow the leaves and dust up into the air so the dust and leaves would magically disappear.
