There is a story bouncing around – I’m pretty sure I saw it on Reason. I used to live in Flint Township Michigan, which is where this happened.
Guy is walking down the street late at night. Police car goes by, then swings by again – the cop puts the lights on the guy. He raises his hands up in the air, since he is carrying an open carry gun. Policeman arrests him because the policeman didn’t see the gun. The law requires that the gun be visible on the side on which it is being worn – it was. It was not visible to the street. The policeman had this notion that the gun must be visible no matter which side the policeman is on. Flint Township is getting their ass sued. Put me on the jury.
But that’s not what got my attention. It mentioned that after he was arrested, they took him in and gave him a blood alcohol test. So they had no probable cause to arrest him in the first place, but they tried to make him a criminal for walking down a street with alcohol in his blood (on Christmas Eve). Fortunately for him, he had none, and no drugs. Good thing he didn’t get the involuntary enema treatment at the hospital over and over.
So being the smartass that I am, I posted on Disqus – “So in Michigan, what is the legal blood limit for walking down the sidewalk with no driver’s license?” 🙂
A “Smart” person replied that I was an idiot of course (this is the Internet)… and that the Limit is 0.00%
Obviously (at least to me), the point of my question was digging around to find out of Michigan has put into statute that your right to open carry a gun is based on having below a certain limit of alcohol in your system. I don’t remember that Asterisk in the emanations of the penumbra of the 2nd amendment.
In my brief research on the topic, apparently prosecutors in Michigan will cite you civilly if you’re carrying openly and have more than 0.02% blood alcohol. Above 0.04% becomes a criminal punishment.
If I was more of an Internet Troll than I already am, I would reply with “So does the 0.00% open carry limit apply if you’re inside your house?”
Michigan – under Engler – was such a beautiful state. The scenery is still there, but Noah needs to visit a few cities.
